Mobile skins, laptop skins, stickers, framed posters offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service," "Terms"), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

SECTION 1 - ONLINE STORE TERMS

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

We may provide you with access to third-party tools that we neither monitor nor have any control over nor input. You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations, or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third party.

We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website should be taken to indicate that all information in the Service or on any related website has been modified or updated.

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content:

The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available for your use, without any representation, warranties, or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall New Graphic Arts | Mobile Skins & Cases, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

SECTION 14 - TRADEMARK, COPYRIGHT, AND GUIDELINES

This site is controlled and operated by New Graphic Arts. All material on this site, including images, illustrations, audio clips, and video clips, is protected by copyrights, trademarks, and other intellectual property rights that are owned and controlled by us or by other parties that have licensed their material to us. Material on the New Graphic Arts website owned, operated, licensed, or controlled by us is solely for your personal, non-commercial use.

You must not copy, reproduce, republish, upload, post, transmit or distribute such material in any way, including by e-mail or other electronic means and whether directly or indirectly and you must not assist any other person to do so. Without the prior written consent of the owner, modification of the materials, use of the materials on any other website or networked computer environment, or use of the materials for any purpose other than personal, non-commercial use is a violation of the copyrights, trademarks, and other proprietary rights, and is prohibited. Any use for which you receive any remuneration, whether in money or otherwise, is a commercial use for the purposes of this clause.

All other trademarks referenced on New Graphic Arts or on the products and services supplied by New Graphic Arts are the properties of their respective owners.

SECTION 15 - DAMAGED GOODS

If you identify a defect in the skin (fitting issues, glue issues, etc.), just mail us some images of the skins that you received within 24 hours of receiving the shipment. After examining the same, we will issue a refund or ship a replacement after discussing it with the buyer. The life and fitting of the skin largely depend on whether it has been applied properly as per the instructions provided in the package. Apart from delivering the best, our greatest priority is providing the best support to our customers. We’re at your disposal round the clock and we’ll do anything to get the job done ‘On-Time!’. If you get any fitting or print issues with your order, the New Graphic Arts team will be happy to replace it with another one. We have noticed that some people take their concerns to social media handles in a way defamatory to New Graphic Arts's Brand name without discussing the same first with our team. This is highly condemned and a necessary legal remedy will be sought against such action.

SECTION 16 - CANCELLATIONS, RETURNS & REFUNDS

Except for any statutory rights of cancellation, once you place your order, you cannot cancel it. Given the customized nature of New Graphic Arts's products, the product's purchased cannot be returned or exchanged. Refunds can be provided for products that are damaged before delivery or in the case of the product bearing a custom logo or other artwork requested by you, product bearing a logo, or other artwork that does not match the logo or other artwork requested by you. If your product appears to be damaged, please contact us promptly at the contact details given.

You cannot cancel the order and demand a refund once the order is successfully placed and processed by the payment gateway. Refund requests will only be considered in the following situations:

• If the buyer does not receive the delivery of the ordered products within 20 days (in India) from the order date.
• If New Graphic Arts fails to ship the ordered products.
• If the shipping location is not serviced by our contracted courier.

No refund requests will be entertained for damaged products. Damaged products will be exchanged by us as soon as brought to our notice. No returns will be entertained if a customer wants to return the product because they don't like it after delivery or if they feel the product doesn't match their expectations, as all products are custom-made by us after receiving the orders. No returns will be entertained if a customer wants to return the product due to minor design and color variations. There will always be some variation in color between products you see online and products you get in hand. There will be no refunds for packages that are returned without email confirmation. New Graphic Arts reserves the right to cancel any order that has been received, including discontinuing any promotional coupon or offer.

Refund requests will not be considered under the following circumstances:

• Incorrect or outdated delivery address.
• After 3 failed delivery attempts by our courier agencies due to the wrong address/contact details.
• Package refused by the recipient.

Under such cases, the buyer will be liable to pay INR 60 as RTO charges, which are charged by the couriers for bringing the products back to our warehouse. The said product will be then reshipped with the updated details. No refund requests or design change requests will be entertained under such circumstances.

SECTION 17 - GOODS UNDELIVERED BECAUSE OF CUSTOMER ISSUES

If an order does not successfully arrive at the delivery address provided during checkout within the recommended time frame, please use the contact info section and let us know. We’ll work with you to get a re-shipment processed and ensure that you receive the product you paid for. We do not provide any refunds based on undelivered items, as delivery is out of our control once an item has left our warehouse. No refunds will be given in the following cases:

SECTION 18 - CUSTOMIZED ORDERS

In case the customer wants any specific wallpaper/image printed on the Skin, liabilities arising from any copyright or other intellectual property violations will belong to the customer. StickersBaba does not bear any responsibility regarding the confidentiality and possible misuse of the custom images being uploaded, however, StickersBaba has done its best to protect the privacy of such images.

SECTION 19 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless StickersBaba and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference or your violation of any law or the rights of a third-party.

SECTION 20 - SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 21 - TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 22 - ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service). Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India.
